Thevictim advised the
defendant arrived at his
residence,driving a Ford F-150
pickup. This occurred between
7-8 a.m. TheVictim stated the
defendant was yelling then
rammed the front gate
leadingonto the property with
the truck causing the gate to
bend inward.The victim stated
he positively identified the
defendant as the only
occupantof the vehicle. The
suspect has willfully,
maliciously harassed the
victimand made credible
threats leaving the victim in
fear of his life.The victim
advised the defendant has
called the residence and
repeatedlythreatened the
victim in the past 30 days.
The defendant has called
himapproximately 150 times
making threats to shoot him
and burn his house down.Victim
stated the defendant is doing
this because the suspect is
angry aboutthe relationship
between the victim's daughter
and himself. Victim stated
heis scared the suspect will
kill him or his family.While
conducting the interview a
Pasco Sheriff's Deputy
intercepted a phonecall made
to the victim. The suspect
made verbal threats to return
to theresidence with a
firearm. Defendant was
located on the pay phone at
U.S. 19and New York Avenue,
Approximately 2 miles from the
victim's home.The suspect was
taken into custody and the
taser was used one time until
hecomplied with the arresting
deputy's commands. The
defendant was also
peppersprayed in an effort to
get compliance.The defendant
was screaming 'I want to see
Crystal' multiple times.
Crystalis the victim's
daughter and is the person the
defendant wanted to see at
thecrime scene.The male victim
is the father of the daughter
who used to be the
suspect'sfianc ...The father
is the one who has been
receiving death threats
fromsuspect and has the
Domestic Violence
Injunction.Maryberry was taken
to the hospital for medical
clearance which he received.
That is standard operating
procedure when a taser is used
in a use of forcecase. He was
booked into the Land O'Lakes
Jail.A supervisor with the
Pasco Sheriff's Office
reviewed the Taser tape and
aprelimary look at the case
shows the deputies actions
were justified. However, a
formal use of force report
will be completed, as is
standardoperating
